Terms of Service

By accessing or using Betify's AI-powered gaming intelligence platform ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), along with our Privacy Policy and any other policies referenced herein.

If you are using the Services on behalf of an organization (such as a gaming operator, affiliate company, or regulatory body), you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.

If you do not agree to these Terms, you must not access or use our Services.

Betify provides an AI-powered platform that offers gaming intelligence, responsible gaming tools, compliance monitoring, and related services. Our Services are designed for four distinct user categories:

To use our Services, you must meet the following eligibility requirements:

• Age Requirement: You must be at least 18 years old, or the legal gambling age in your jurisdiction, whichever is higher.
• Legal Capacity: You must have the legal capacity to enter into binding contracts in your jurisdiction.
• Jurisdiction: You must be located in a jurisdiction where online gambling and our Services are legal.
• Not Self-Excluded: You must not be registered on any self-exclusion program that would prohibit your use of gambling-related services.

To access certain features of our Services, you must create an account. When registering, you agree to:

• • Maintain and promptly update your information to keep it accurate and complete
• • Maintain the security and confidentiality of your login credentials
• • Immediately notify us of any unauthorized use of your account
• • Accept responsibility for all activities that occur under your account

• • Not create multiple accounts for fraudulent purposes

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof, are the exclusive property of Betify Ltd or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Services for their intended purposes. This license does not include the right to:

• • Sell, license, or commercially exploit any content
• • Use data mining, robots, or similar data gathering tools
• • Download or copy account information for third parties
• • Use our trademarks without written permission

Certain features of our Services require payment of fees. By subscribing to a paid plan, you agree to pay all applicable fees as described on our pricing page.

7.1 Billing

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. All fees are non-refundable except as expressly stated in these Terms or required by law.

7.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings.

7.3 Price Changes

We reserve the right to change our prices at any time. Price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing period.

Betify is not a gambling operator and does not offer gambling services. Our AI-powered recommendations are for informational purposes only and do not constitute gambling advice. We do not guarantee any particular outcome from using our Services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETIFY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• • Your access to or use of (or inability to access or use) the Services
• • Any conduct or content of any third party on the Services
• • Any content obtained from the Services
• • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €100.

You agree to indemnify, defend, and hold harmless Betify and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising from or relating to your use of the Services, your violation of these Terms, or your violation of any rights of another.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by contacting us or through your account settings. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any dispute arising from or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration in accordance with the rules of the Malta Arbitration Centre.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Betify regarding the Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
